Terms and Conditions for Ticket Sales and Participation at the Alcohol Industry Trade Fair
Whisky Festival 2026 Sopot
I. DEFINITIONS
The terms used in these regulations have the meaning assigned to them below
CBMAX or Organiser – CBMAX Spirits Limited Liability Company with its registered office at Wejherowska 67, 84-240 Reda, entered into the register of entrepreneurs from the National Court Register kept by the District Court Gdańsk-Północ in Gdańsk, VIII Commercial Department of the National Court Register, under number 0000502527, REGON: 222050990, NIP: 5871701725, share capital: PLN 14,682,400; the event organiser, distributing entry tickets to the alcoholic beverage industry fair – Whisky Festival 2026 Sopot via the Service.
Festival – drinks industry trade fair – Festival Whisky 2026 Sopot, which may be attended by adults, including consumers, who are fully legally capable, upon prior effective purchase of a Ticket – in accordance with the principles set out in these regulations.
Ticket – a personal confirmation of the conclusion of an agreement using the Service, enabling the Buyer and adult persons (i.e. those who have reached the age of 18) for whom the Ticket has been purchased, to participate in the Festival; the Ticket also serves as proof of payment.
Wristband – a strap for the wrist, to bearer, issued to the Ticket holder upon presentation of the Ticket, confirming the entitlement to participate in the Festival.
Festival Package – consists of a wristband, a tasting glass with a festival lanyard, a cashless card (i.e. a card for making payments on the Festival grounds – excluding the festival shop), a festival bag, and a festival booklet.
Service – the website https://festiwalwhisky.pl/, through which, among other things, services related to the purchase of Tickets and the provision of information regarding the Festival are provided.
Venue – the place where the Festival will be held, i.e. Hipodrom Sopot area, ul. Polna 1, 81-745 Sopot.
Terms and Conditions – these terms and conditions, defining the rules for purchasing Tickets, the rights of participants, and the obligations of Ticket purchasers, Festival participants, and the Organiser; the Terms and Conditions are the document referred to in Article 8 of the Act on the Provision of Electronic Services (consolidated text: Journal of Laws of 2024, item 1513, as amended); before purchasing Tickets, the Buyer accepts the Terms and Conditions, including declaring that all Tickets are purchased for adult individuals. When exchanging a Ticket for a Festival Package, a participant who was not the Buyer is obliged to familiarise themselves with the Terms and Conditions (available at
Entrance to the Property – Entry to the Property shall be deemed as confirmation that the Participant has familiarised themselves with the Regulations, understands their rights and obligations, and undertakes to comply with them strictly.
II. General Principles
The Regulations contain provisions concerning the sale of Tickets via the Service, payments for Tickets and during the Festival, as well as the rules of participation in the Festival.
2. The Buyer accepts the terms and conditions of the Regulations before making a purchase through the Service.
3. Use of the Service is possible after the Buyer's teleinformatic system meets the following minimum technical requirements:
a) the Buyer obtaining, at their own expense, access to a computer workstation or end-user device with Internet access;
b)using any current internet browser (e.g. Edge, Internet Explorer, Mozilla Firefox, Opera, Google Chrome);
c) Java applet support enabled in the browser.
4. Commercial information published on the Service does not constitute a commercial offer within the meaning of the Civil Code, but merely constitutes an invitation to make offers. Invitations to make offers may be changed at any time; a sales contract is concluded according to the invitation to conclude it which was current at the time the order was placed and was accepted by the Organiser. The assessment of the currentness of the invitation to conclude a contract is made according to the actual prices of Tickets from the Service, not according to the published invitations to conclude a contract.
III. Terms of Service
1. In fulfilment of the obligation imposed by Article 15(1)(2) of the Act of 26 October 1982 on Sobriety and Alcohol Abuse Prevention (consolidated text: Journal of Laws of 2023, item 2151, as amended), which prohibits the sale and serving of alcoholic beverages to persons under the age of 18, CBMAX requires the Buyer to make an appropriate declaration and for the Buyer and persons for whom Tickets are purchased to familiarise themselves with the Regulations. Before admission to the Venue, as well as at any other time, the Organiser is entitled to verify the truthfulness of the Buyer's data and that of other participants, and in the event of finding that the requirement to be over 18 years of age has not been met, to refuse admission to the Venue, without the right to reimbursement of the costs of purchasing Tickets and other costs incurred by the Buyer or participants.
2. The condition for submitting a tender request for the purchase of a Ticket is your agreement to the terms of the Regulations and the provision of personal data marked as mandatory.
3. Buyer's Obligations. The Buyer is obliged, in particular, to:
a) the submission of declarations enabling the Organiser to provide services using the Website in accordance with the law (in particular, declarations that Buyers and persons for whom Tickets are purchased are over 18 years of age);
b) not delivering or transmitting content prohibited by law, in particular content promoting violence, defamation, or infringing upon personal interests and other rights of third parties;
c) not undertaking actions contrary to the law, good practices, and the principles of fair trade;
d) using the Service in a manner:
– not disrupting its functioning, in particular by using safe and legal software and devices;
– unobtrusive for other Users of the Service and for CBMAX;
– in compliance with the regulations in force in Poland, the provisions of the Regulations, and the general principles of safe Internet use;
e) use of the content posted on the Service solely for personal, non-commercial use – it is particularly prohibited to (i) distribute or post unsolicited commercial information (spam) on the Service, (ii) use data from the Service for sending spam.
4. CBMAX shall not be liable for the Buyer's provision of incorrect data or failure to provide data necessary for the Organiser to submit a Ticket purchase offer, for the purchase of Tickets, or for the fulfilment of the Buyer's or Organiser's rights and obligations.
IV. TICKET SALES
1. The Buyer will only be able to submit an offer to purchase Tickets after successfully completing the form provided on the Website, i.e. by indicating all data designated as necessary.
2. The Buyer submits an offer to the Organiser, specifying how many and which Tickets they wish to purchase. Depending on availability, the Organiser accepts the Buyer's offer in full, in part, or rejects it, stating the reason (e.g., lack of availability, failure to provide data necessary for concluding the agreement and finalising the transaction).
3. The ticket is generated automatically in electronic form and sent to the e-mail address provided by the Buyer. Tickets are available exclusively in electronic form until the Festival day. To purchase a Ticket, it is necessary to provide at least the first name, surname, and e-mail address, accept the declarations displayed on the Website, the Regulations, and confirm payment by the Organiser.
4. There are 7 types of tickets on sale:
a) One-day early bird ticket for Friday, 28.08.2026 at the price of PLN 280 (available for purchase from 25.05 – 25.06.2026);
b) Saturday, 29.08.2026 'early bird' one-day ticket at £280 (available for purchase between 25.05 – 25.06.2026);
c) Two-day early bird ticket for £460 (available from 25.05 – 25.06.2026);
d) a day ticket for Friday, 28.08.2026, costing PLN 330;
e) a day ticket for Saturday, 29.08.2026, at the price of PLN 330;
f) Two-day pass for 540 PLN;
g) two-day VIP ticket for £1,500 (while stocks last).
5. The organiser also offers pools of tickets for industry lectures, called „Masterclasses”, concerning selected types of products.
6. Tickets designated as early bird are available on the Service during the period 25.05.2026 – 25.06.2026. After this period ends, tickets may be purchased at
price indicated in points d) to i) above. This does not apply to VIP two-day tickets, which may be purchased at the indicated price until the stock is depleted throughout the entire period of ticket sales for the Festival; however, as their stock is limited, they will be available until stocks last, about which the Organiser will inform by posting appropriate information on the Service.
7. The sales contract between the Buyer and CBMAX is concluded upon fulfillment of the required procedures for purchasing Tickets on the Service and upon receipt of payment by CBMAX. The conclusion of the contract and the purchase of Tickets are confirmed by the Buyer receiving the Tickets – sent to the e-mail address specified by them.
8. Ticket payments are processed using the Tpay system, provided by Krajowy Integrator Płatności S.A. based in Poznaniu, NIP: 7773061579, company registration number KRS: 0000412357 (hereinafter referred to as the „Supplier”); CBMAX shall not be liable for any consequences arising from any irregularities in the Supplier’s payment system. Payment
Failure of confirmation by the Buyer's bank within 2 hours of placing the order will result in its automatic cancellation. In the event that the lack of confirmation may result from the incorrect operation of the payment system, the Buyer should report it directly to the payment operator.
9. Individuals paying via a foreign bank should consider bank intermediation costs, as only full payment within the specified deadline guarantees CBMAX's order fulfilment.
10. Ticket prices include VAT. To receive a VAT invoice, please provide your invoicing details by indicating them in the appropriate field in the form when making an offer to purchase Tickets.
11. The ticket is a good with digital elements within the meaning of the Consumer Rights Act of 30 May 2014 (consolidated text: Journal of Laws of 2024, item 1796, as amended). A good with digital elements is a good containing or integrated with digital content or digital services in such a way that the absence of the digital content or digital service would prevent its proper functioning.
12. The sale of tickets as goods with digital elements is not subject to separate taxation, and therefore the Buyer does not receive a fiscal receipt. Proof of purchase is the electronic ticket.
13. CBMAX is entitled to terminate the sale of Tickets via the Service at any time, without providing a reason.
RETURNS
1. Given the nature of the product being sold (goods with digital elements) and the consent the Buyer will be required to give in relation to this before finalising the purchase of Tickets, the return of Tickets will not be accepted, except in cases of Festival cancellation, or a change to the Festival date or venue by the Organiser. The Buyer should therefore make their purchases carefully, ensuring before finalising the transaction that the chosen product meets their expectations. Reimbursement shall be made promptly, no later than 14 days from the date of notification of Festival cancellation. In the event of a change to the event date or venue, if the Buyer informs the Organiser of their unwillingness to attend the Festival at the new location or time, reimbursement shall be made within 14 days of receiving notification from the Buyer. The Organiser will reimburse payments in a manner analogous to the payment method chosen by the Buyer.

3. Contact is available within the following hours: Monday to Friday, 9:00 AM to 5:00 PM, excluding public holidays (Saturdays, Sundays, holidays). All replies are provided in the order in which inquiries were received.
4. In the event of the Festival being cancelled, or its date or venue being changed, entitling the ticket holder to return tickets, the refund by the Organiser shall only cover the price of the purchased tickets and shall not cover any additional costs, such as fees charged by payment operators. Refunds will be processed within 31 days of the designated date of the Festival or the date for which the returned ticket was purchased; refunds will be issued in the same manner as the original payment was made.
5. Any refunds made by the Organiser based on these Regulations or applicable laws shall be made solely to the Buyer, not the Participant, if the Participant was not the purchaser of the Tickets.
VI. COMPLAINTS REGARDING TICKETS
1. CBMAX, as the seller, is liable to the Buyer who is a consumer within the meaning of Article 221 The Civil Code, for non-conformity with the sales contract for the acquired Ticket, within the scope defined by the Consumer Rights Act of 30 May 2014 (consolidated text: Journal of Laws of 2024, item 1796 with subsequent amendments).
2. The basis and scope of the Organiser's liability, as the seller of Tickets, for warranty covering physical and legal defects, are defined in the Civil Code.
The Organizer does not provide guarantees for products purchased on the Service or received as part of the Festival Package.
4. Complaints should be submitted via email to kontakt@festiwalwhisky.pl. The message must include as much information and detail as possible regarding the subject of the complaint, in particular: the type and date of the anomaly, confirmation of payment for the Tickets, and the contact details of the complainant (email and phone number, or email address only). Only the Buyer may submit a complaint. The information provided will significantly facilitate and speed up the review of the submitted reservations by CBMAX.
5. CBMAX undertakes to consider a complaint within 14 days, and if this is not possible, to inform the Buyer within this period when the complaint will be considered. If the submitted complaint is upheld, the refund will be made immediately, no later than 14 days from the date the complaint is acknowledged. The organiser will refund the payment in a manner analogous to the payment method chosen by the Buyer.
6. The Buyer shall choose the basis of the complaint and the claim sought.
7. The Buyer, being a Consumer, also has the right to use out-of-court dispute resolution methods, in particular by submitting, after the complaint procedure is completed, a request for mediation or a request for the case to be considered by an arbitration court (the request is available on the website www.uokik.gov.pl). A list of permanent arbitration courts operating at regional inspectorates of the Trade Inspection (hereinafter referred to as „WIIH”) is also available on the website of the respective WIIH. The Consumer may also use the free assistance of a district (city) consumer ombudsman or a social organisation whose statutory duties include the protection of consumers.
VII. COMPLAINTS REGARDING THE PROVISION OF SERVICES BY ELECTRONIC MEANS ELECTRONIC.
1. To ensure the security of message and data transmission in connection with the services provided, CBMAX takes technical and organisational measures appropriate to the level of security risk of the services provided, in particular measures to prevent unauthorised persons from obtaining and modifying personal data posted in the Service, sent electronically to the Organiser.
CBMAX shall take action to rectify any irregularities reported by Buyers within a reasonable timeframe.
3. The Service user should promptly notify CBMAX of any irregularities or interruptions in the Service's operation via email sent to kontakt@festiwalwhisky.pl or by using the contact form available on the Service. The notification should include the user's first and last name, email address for correspondence, the type and date of the irregularity related to the Service's operation, and any other information that may be useful in resolving the problem by the Service administrator.
CBMAX undertakes to consider each complaint within 14 days of its submission, and if this is not possible, to inform the complainant within this period when the complaint will be considered.
5. Given that payments made through the Service are handled by an external provider of cashless transaction services, as indicated in point 4, section 6 of the Regulations, in the event of any irregularities concerning payments, complaints will be handled by the Provider, and notifications should be made in the manner specified by the Provider (information regarding the procedure for contacting the Provider is provided in the link mentioned in point 4, section 6 of the Regulations).
6. If the submitted complaint is upheld, reimbursement will be made immediately, no later than 14 days from the date the complaint is acknowledged. The Organiser will refund the payment in a manner analogous to the payment method chosen by the Buyer.
VIII. RULES FOR ADMISSION TO AND PARTICIPATION IN THE FESTIVAL.
1. The Organiser shall record the course of the Festival for the purposes of Festival documentation and the use of audiovisual materials for the Organiser's statutory activities related to the organisation of subsequent Festival editions, the preparation of reporting materials, and other undertakings by the Organiser. The image of persons present on the Premises may be recorded and subsequently distributed for documentation, reporting, advertising, and promotional purposes, carried out in accordance with the principles established by current regulations, to which the Participant consents upon entering the Festival grounds.
2. To attend the Festival, you must present your Ticket to the Organiser before entering the Premises. The Ticket may be in a paper version (a printed electronic document received by the Buyer via email) or an electronic version (attached to an email sent by the Organiser, presented on an electronic device by the person intending to attend the Festival). Based on the presented valid Ticket, the Organiser verifies the possibility of participation (in particular, by checking if the attendee has reached the age of majority) and exchanges the Ticket for a Festival Pack. and performs other actions necessary to ensure participation in the Festival
to the person presenting the Ticket (e.g. by providing organisational and safety information).
3. By exchanging their Ticket for a wristband, the participant confirms that they have read the Regulations, in particular the rules of participation in the Festival.
4. Only individuals who are of legal age (i.e., have attained 18 years of age) and sober may participate in the Festival. Festival participants are obliged to allow the Organiser to verify their age by presenting appropriate identification – a personal identity card or passport (also in the form available in the mObywatel app) – upon request.
5. Adult individuals accompanied by minors will not be admitted to the premises.
6. The organiser reserves the right to request disruptive, inappropriate, intoxicated individuals, or those whose condition indicates they are under the influence of narcotic substances, to leave the Festival, particularly if their behaviour disturbs the peace, order, or the unimpeded participation of other attendees.
7. A ticket holder who does not confirm, with appropriate documentation (ID card, passport), that they are over 18 years of age, or refuses to show it, is intoxicated, aggressive, or their condition indicates the consumption of other intoxicating substances, will not receive the Festival Pack and will not be admitted to participate in the Festival. In such a case, CBMAX will not refund the ticket price, nor shall it be liable in any other way towards the Buyer or any person attempting to enter the Festival grounds.
8.The wristband may not be removed at any time during the Festival nor transferred to another person during the event, under penalty of refusal of entry/removal from the Premises. The Festival Package is non-returnable and non-refundable.
9. The festival takes place on 28 and 29 August 2026 in Sopot, at the Venue. Participants holding a valid Ticket are entitled to enter the event grounds on these days between 11:00 and 23:00.
10. Participants may remain on the Festival grounds from the commencement of the event until its conclusion, and are then obliged to leave the Premises without undue delay. Service at the festival stands will cease at 10:45 PM.
11. Rules for using the purchased ticket:
a) The ticket must be exchanged for a Festival Pass and secured to prevent its components from being damaged or lost.; Festival Package items are non-refundable and non-exchangeable once collected by the Festival participant, even if lost. any of the elements or their damage; this also applies to the cards issued in the Festival Pack, which enable payments at the Venue during the Festival;
b) In the event of losing or damaging a tasting glass, the participant is obliged to purchase a new glass for PLN 15 at the festival shop;
c) Festival alcoholic beverages will be served in festival glasses only at the festival stalls; no single-use containers will be provided, and drinks will not be available for tasting in participants' own containers;
d) Unused tickets are not eligible for return or refund of their purchase price by CBMAX.;
e) Tickets and wristbands issued are for single use only and do not permit the entry of other persons.
10. Individuals whose behaviour creates a potential threat to public order or may endanger others are not permitted on the premises. Such individuals will be denied entry to the Festival grounds or will be removed from them. Individuals present at the Festival are obligated to behave in a manner that does not endanger the safety of others, and in particular, to adhere to applicable laws, regulations, and recommendations.
11. The Festival grounds are off-limits for the entry of dangerous tools and substances, such as weapons, explosives, pyrotechnic products, including bangers, sparklers, flares, torches, etc., fire hazards, intoxicating substances, alcoholic beverages, psychotropic substances, and items that could endanger human life or health, including baseball bats, truncheons, metal pipes, knives, etc.
12. The organiser reserves the right to inspect the clothing and luggage of individuals entering and staying at the Festival, in order to maintain proper order and safety; individuals who refuse to comply with this will not be admitted or will be asked to leave the Premises, without the right to a refund of any fees paid.
The organiser does not keep a deposit for items that are prohibited from being brought into and possessed during the Festival.
14. It is forbidden to damage property located within the Festival grounds, in particular information boards, bins, benches and any other items, as well as to arbitrarily move equipment and property located within the Festival grounds and to start fires.
15. It is forbidden to behave in a provocative manner or to incite the disturbance of order and safety, which may constitute a seedbed, in particular due to gender, race, religious denomination, sexual orientation, age, beliefs, or for any other reason.
16. Persons at the Festival who disturb the peace, pose a threat to others, violate good conduct, or bring prohibited items against the ban, or fail to comply with the Regulations, shall be removed from the Festival, without the right to a refund of any fees paid. If such persons, by their conduct, commit an offence, they may face consequences provided for by law.
17. Festival attendees will only have access to specific zones, in accordance with the rules set by the Organiser.
18. It is forbidden to block or obstruct in any way emergency exits and escape routes, access roads for rescue services and the police, and hydrants and other equipment necessary during rescue or firefighting operations.
19. Festival attendees must inform the Organiser or security of any observed incidents that could pose a threat to the Festival or persons present on the premises, in particular fire, direct threat to life, human health or property.
20. The organiser is not liable for any property left on the Festival grounds.
21. The Organiser, taking into account participant safety, reserves the right to change the date and times of the Festival or to cancel it. The Participant is obliged to follow the Organiser's instructions.
All vehicles parked on the Festival grounds without the proper pass authorising entry and parking, and left on evacuation routes or access points for emergency services and police, will be towed at the owner's or holder's expense.
23. Individuals exhibiting symptoms of illness or any health problems are obliged to immediately contact the Organiser or a medical point located on the Festival grounds. The Participant acknowledges and
I accept that the Organiser is not responsible for any infection with any illness during and in connection with the organisation of the Festival. The Participant waives any claims against the Organiser in this regard and participates in the Festival solely at their own risk and responsibility.
24. Purchasing products at the Festival: Alcoholic beverages (to the extent not covered by the vouchers received), non-alcoholic beverages, and food and snacks may be purchased by attendees at the Venue – from designated stalls; Payment for the above goods will only be possible using so-called cashless cards – electronic tools for making payments at individual stands equipped with cashless card readers;
To use the cashless payment option, participants will need to top up their card at the ticket office or at designated points within the Venue, with any amount not less than PLN 20 and not exceeding PLN 2,000; multiple top-ups of cashless cards are permitted, within the limits indicated in this point; the balance of funds available on the cashless card can be checked at any of its readers, by holding the card to the reader; the balance will be displayed on a printout;
the cashless card is activated at the moment of the participant's first top-up of funds;
payment using a cashless card is made at the moment it is placed on a reader available at the given stall;
The supplier of cashless readers and cards is the Supplier indicated in point 4, paragraph 6 of the Regulations; the Organiser is not responsible for disruptions in the operation of the cashless card system caused by circumstances beyond their control, however, they undertake to make every effort to resolve problems related to the functioning of the system as quickly as possible and to maintain constant contact with the system supplier, enabling them to take appropriate corrective actions.;
since the cashless cards are not personalised, they do not have a serial number or any other identifier that would make it possible to identify the card or the participant, the participant alone bears responsibility for the funds stored on them; losing or damaging the card will prevent the participant from using it further – duplicates of cards are not issued, and transferring funds from one card to another will also not be possible; for this reason, the Organiser suggests that participants, where possible, procure a suitable holder, in order to minimise the risk of losing or damaging the cashless card (holders are not part of the Festival Package!);
In case of damage or loss of the cashless card, the participant can only purchase a new cashless card for PLN 15 and top it up within the aforementioned monetary limits.;
Funds accumulated on the cashless card, unused at festival stands, are not eligible for payout. Participants have the option to cash them in between 30.08.2026 and 29.09.2026 at „Dom Whisky” Cocktail Bars run by the Organiser in the following locations:
Warsaw, Nowy Świat 32; Sopot, Grunwaldzka 1/3; Jastrzębia Góra, Droga Rybacka 60.
A festival shop will also be available on the festival grounds, where alcoholic beverages from the Organiser's offer can be purchased. Payments in the festival shop will be made using means of payment available in regular circulation, i.e. cash, debit and credit cards, and the BLIK system, excluding payments made with cashless cards.
IX. PRIVACY AND PERSONAL DATA
Due to the specific nature of the Festival and the need to verify the age of individuals presenting a Ticket, when ordering through the Service, the Buyer shall provide personal data by completing a form. The Buyer also consents to the verification of their identity and age at the time of exchanging the Ticket for the Festival Pack, as well as at any other time if necessary.
The Buyer may consent to receiving commercial, promotional, and marketing information by electronic means of communication, in particular by e-mail, in accordance with the Act on the Provision of Electronic Services or profiling. In such a case, the Buyer's personal data may be processed by CBMAX also for advertising, market research, or behaviour and preference analysis purposes, with the results of such research intended for improving the quality of services provided by CBMAX, which also includes the consent given by the Buyer.
The buyer, by accepting the relevant clauses posted on the Service, agrees to:
a) processing of personal data for purposes related to customer service and the provision of electronic services, and the conclusion and performance of the Ticket sales agreement – consent is necessary for the conclusion and performance of the agreement;
b) the Promoter passing on to the Buyer information relating to the Festival – consent required;
c) transmitting commercial and marketing information to the Buyer within the meaning of the Act on the Provision of Services by Electronic Means by CBMAX – voluntary consent, which can be withdrawn at any time.
On the basis of Article 13(1) and (2) and Article 14(1) and (2) of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation), CBMAX informs that:
a) the controller of personal data of users of the Service, Buyers, participants and other persons whose data has been transferred to the Organiser, is CBMAX (the administrator's registration details are indicated in point 1 of the Regulations);
b) in case of doubts related to personal data processing or the need to carry out other processing activities Personal data of the User (e.g., withdrawal of consent for the processing of such person's data), please contact CBMAX via e-mail sent to: kontakt@festiwalwhisky.pl;
c) personal data of the User of the Service, the Buyer and other persons whose personal data will be transferred to the Organiser in connection with the purchase of Tickets, participation in the Festival, lodging of a complaint, or issuing an invoice, are transferred to CBMAX by the User of the Service or the Buyer – depending on which stage of electronic service provision the submission of data concerns (after purchasing Tickets, it will be the Buyer);
d) personal data of users of the Service are processed for the purposes of:
providing services electronically by CBMAX to the User of the Service, including for correspondence and direct distance communication, as well as for the possible establishment and pursuit of claims, including those reported within complaint procedures, or defence against them – which constitutes CBMAX’s legitimate interest, i.e. based on art. 6(1)(f) GDPR;
fulfilment of legal obligations incumbent upon CBMAX, e.g. the obligation to provide information resulting from personal data protection regulations or the Consumer Rights Act, i.e. on the basis of art. 6(1)(c) GDPR;
e) the Buyer's personal data is processed for the purposes of:
the conclusion and execution of the Ticket sales agreement, including correspondence and direct communication at a distance, in particular for transmitting information concerning the Festival, as well as for the potential establishment and pursuit of claims, including those raised within the framework of complaint procedures, or defence against them – which constitutes a Legally justified interest of CBMAX, i.e. on the basis of Art. 6 par. 1 lit. b) and lit. f) GDPR;
the fulfilment of legal obligations incumbent upon CBMAX, e.g. the obligation information resulting from data protection regulations or consumer rights acts, i.e. under Article 6(1)(c) GDPR;
marketing content, service offers and goods offered by CBMAX or entities belonging to the same group, co CBMAX, newsletters and other information unrelated to the organisation by participating in the Festival, if the User expresses their separate, voluntary consent, which can be withdrawn at any time, to pursuant to Article 6(1)(b) of the GDPR;
f) data is processed and falls under the category of personal data: name and surname, email address; in in the event that the Buyer expresses their wish to receive an invoice, they will be processing the following data: name and surname, address e-mail, billing address and Nip.
g) recipients of personal data may include CBMAX service providers (e.g. IT, consultancy, postal and transport service providers., security, banking, insurance, debt collection), entities belonging to the same capital group, if such transfer or processing is necessary to enable the use of Service, including for the purchase of tickets, and also, if such an obligation stipulated by law – central government and local government bodies, Law enforcement agencies, ordinary and administrative courts;
h) data provided by the user of the Service in order to conclude sale agreements for tickets in his name or the exercise of rights arising, in particular, with the possibility of lodging a complaint, are covered by its consent, necessary for carrying out these activities for the benefit of the user Services by the Organiser;
i) personal data provided voluntarily will be processed until withdrawal of consent; withdrawal of consent does not affect the lawfulness processing of data that was carried out on the basis of consent before its withdrawal; notwithstanding the withdrawal of consent, the controller shall be able to process personal data for the purposes of establishing, investigating or defending its claims or other circumstances arising from the applicable legal provisions, e.g. tax settlements;
j) the data retention period will depend on the activity for to which they were transferred, the applicable limitation periods claims and public law receivables related to the conduct of business activities by CBMAX (e.g. in the area of settlement VAT);
Personal data will not be transferred outside the European Economic Area. Economic Area;
l) Each person whose data is processed by CBMAX has the right to access their personal data being processed, and the right to rectify, erase, restrict processing, data portability, and object; objections should be submitted to CBMAX in writing (to CBMAX's registered address entered in the KRS entrepreneurs' register or to the office address in Warsaw: CBMAX Spirits sp. z o.o., ul. Dziekońskiego 3, 00 – 728 Warsaw) or via e-mail (to the address kontakt@festiwalwhisky.pl), stating reasons related to the specific situation of the person lodging the objection (Art. 21(1) GDPR);
m) personal data shall not be subject to automated processing, including profiling, or automated decision-making, unless the data subject has given separate, voluntary, and revocable consent at any time.
X. FINAL PROVISIONS
The content published on the Service is protected by copyright and is the property of CBMAX or other entities that have granted CBMAX a licence covering permission to
their use on the Service. The User of the Service bears full responsibility for any damage caused to CBMAX as a result of using such content without CBMAX's consent. Such unauthorised use (in particular copying, distributing, and creating derivative works of individual elements of the Service, as well as its appearance as a whole) constitutes an infringement of copyright belonging to CBMAX and results in liability, in particular civil liability.
Trademarks featured on the Service are also protected by law, under intellectual property law and other regulations, in particular those establishing the rules for trademark registration and the protection derived from such registration.
Disputes arising between CBMAX and the Buyer, who is a consumer within the meaning of the law, in the event of their inability to resolve them amicably, shall be subject to adjudication by the competent courts, in accordance with the provisions of the Code of Civil Procedure.
When purchasing a Ticket, the Service user undertakes to familiarise themselves with and abide by the Regulations, as well as to provide these documents to any person for whom they purchased a Ticket via the Service.
The regulations are subject to the law in force in the territory of Poland.
