TERMS AND CONDITIONS FOR TICKET SALES IN THE ALCOHOL INDUSTRY FAIR – WHISKY FESTIVAL 2025

  1. DEFINITIONS

Terms used in these Terms and Conditions shall be understood as follows:

  1. CBMAX or the Organizer – CBMAX Spirits spółka z ograniczoną odpowiedzialnością, with its registered office in Reda, ul. Wejherowska 67, 84-240 Reda, entered into the Register of Entrepreneurs of the National Court Register maintained by the District Court Gdańsk- Północ in Gdańsk, 8th Commercial Division of the National Court Register, under number 0000502527, REGON: 222050990, NIP: 5871701725, share capital: PLN 14,682,400; organizer of the event and distributor of tickets for the Alcohol Industry Fair – Whisky Festival 2025 via the Service.
  2. Festival – the Alcohol Industry Fair – Whisky Festival 2025, open to adult consumers with full legal capacity, upon prior successful purchase of a Ticket in accordance with the provisions of these Terms and Conditions.
  3. Ticket – a personalized confirmation of a contract concluded via the Service, allowing the Buyer and persons for whom the Ticket was purchased to participate in the Festival; also serves as proof of payment.
  4. Wristband – a bearer wrist strap issued to the Ticket holder upon presentation of a valid Ticket, confirming eligibility to participate in the Festival. The wristband must not be removed for the entire duration of the Festival, under penalty of denial of entry or removal from the Venue.
  5. Service – the website http://festiwalwhisky.pl/ through which services related to ticket purchases and Festival information are provided.
  6. Venue – the location of the Festival, i.e., Sopot Hipodrom, ul. Polna 1, 81-745 Sopot.
  7. Terms and Conditions – these regulations outlining the rules for ticket purchases, consumer rights, and obligations of ticket buyers, Festival participants, and the Organizer; this document is referred to in Article 8 of the Polish Act on Providing Services by Electronic Means (Journal of Laws 2024, item 1513, as amended).
  8. Festival Participation Rules – a separate set of regulations established by the Organizer, acceptance of which is required by the Buyer when purchasing a Ticket or before entering the Venue.

2. GENERAL PROVISIONS

  1. These Terms and Conditions govern ticket sales via the Service.
  2. The Buyer must accept these Terms and the Festival Participation Rules before making
    a purchase.
  3. In particular, the Terms and Conditions specify:
    1. The rules for using the Service, including electronic ticket purchases and contract formation.
    2. The rules for personal data processing.
  4. Use of the Service is possible if the Buyer’s IT system meets the following minimum technical requirements:
    1. Access to a computer or device with internet connection.
    2. Use of any up-to-date web browser (e.g., Edge, Internet Explorer, Mozilla Firefox, Opera, Google Chrome).
    3. Java applet support enabled in the browser.
  5. Information posted in the Service does not constitute an offer within the meaning of the Civil Code but only an invitation to submit offers. These invitations are subject to change at any time. A sales contract is concluded according to the invitation in effect at the time of order placement and accepted by the Organizer. The current price in the Service determines validity, not the posted invitations.

3. TERMS OF USE OF THE SERVICE

  1. In compliance with Article 15(1)(2) of the Act on Upbringing in Sobriety and Counteracting Alcoholism of October 26, 1982 (Journal of Laws 2023, item 2151) which prohibits the sale and serving of alcoholic beverages to persons under 18 years of age, CBMAX requires the provision of personal data necessary for submitting a Ticket purchase offer and for the preliminary verification of age (18+). The age of the Buyer and the persons for whom tickets are purchased may be verified by the Organizer at any time, particularly upon ticket-to-wristband exchange or during the Festival.
  2. Submitting a ticket purchase offer requires acceptance of these Terms and the provision of mandatory personal data.
  3. Providing incomplete, false, or incorrect data in the registration form prevents the submission of the offer and acceptance of the invitation to contract. The Organizer is not responsible for any actions, omissions, or consequences caused by the Buyer, including those affecting third parties.
  4. To ensure secure communication and data transmission in connection with the services provided, CBMAX implements technical and organizational measures adequate to the level of risk, particularly measures that prevent unauthorized access to or modification of personal data submitted through the Service.
  5. Buyer Obligations – The Buyer is especially obligated to:
  1. Not upload or transmit content prohibited by law, particularly content promoting violence, defamatory material, or content violating personal rights or other rights of third parties.
  2. Not engage in actions contrary to the law, good morals, or principles of fair trade.
  3. Use the Service in a manner that:
  1. Does not disrupt its functionality,
  2. Is not burdensome to other users or CBMAX,
  3. Complies with applicable Polish law, these Terms and Conditions, the Festival Participation Rules, and general Internet safety principles.
  4. Use the content on the Service solely for personal, non-commercial purposes. Specifically prohibited:
  1. Sending or posting unsolicited commercial messages (spam),
  2. Using Service data for spamming purposes.
  3. CBMAX is not liable for the provision of incorrect data by the Buyer or failure to provide data necessary for the offer, ticket purchase, or exercising rights and duties by either party.

4. TICKET SALES

  1. The Buyer can submit an offer to purchase Tickets only after successfully completing the form on the Service, including all required fields.
  2. The Buyer submits an offer to the Organizer specifying the number and type of Tickets. Depending on availability, the Organizer may accept the offer in full, in part, or reject it with reasons (e.g., unavailability, missing required data).
  3. Tickets are generated electronically and sent to the e-mail address provided by the Buyer. Tickets are available exclusively in electronic form until the Festival date. The purchase requires at least a first name, last name, and e-mail address, acceptance of the required declarations, these Terms, the Festival Participation Rules, and confirmation of payment by the Organizer.
  4. There are six (6) ticket types available:
  1. Early bird single-day ticket for Friday, August 22, 2025 – PLN 225 (limited availability);
  2. Early bird single-day ticket for Saturday, August 23, 2025 – PLN 225 (limited availability);
  3. Early bird two-day ticket – PLN 399 (limited availability);
  4. Regular single-day ticket for Friday, August 22, 2025 – PLN 275;
  5. Regular single-day ticket for Saturday, August 23, 2025 – PLN 275;
  6. Regular two-day ticket – PLN 450.

Early bird tickets are available at the beginning of the sales process. Once the limit (set individually for each type) is reached, only regular tickets (items d–f) will remain available.

  1. Ticket quantities are limited. Once the limit is reached, sales will end – tickets will no longer be available online or at the Venue. If the limit is not reached, tickets may be available at on-site ticket booths during the Festival.
  2. The sales agreement is concluded between the Buyer and CBMAX upon completion of the required steps in the Service and receipt of payment by CBMAX. The contract is confirmed by the delivery of tickets to the Buyer’s e-mail address.
  3. Payments are processed via bank transfer or payment card through PayU S.A., ul. Grunwaldzka 186, Poznań, via www.platnosci.pl

CBMAX is not liable for any consequences of malfunctions in the PayU payment system.

  1. If the Buyer’s bank does not confirm the payment within 2 hours of order placement, the order is automatically canceled. If the delay results from PayU system errors, the Buyer should contact PayU directly (https://poland.support.payu.com/s/?language=pl).
  2. Buyers using foreign banks should consider additional bank transfer fees. Only full payments received on time guarantee order processing.
  3. Ticket prices include VAT. Buyers can request a VAT invoice by entering invoice data in the appropriate field during the offer submission process.
  4. A Ticket is considered a good with digital elements under the Polish Consumer Rights Act of May 30, 2014 (Journal of Laws 2024, item 1796, as amended). Such a good cannot function properly without its digital content or service.
  5. Because Tickets are goods with digital elements, no fiscal receipt is issued. The electronic ticket itself serves as proof of purchase.
  6. CBMAX reserves the right to end ticket sales via the Service at any time without providing reasons.

5. BASIC RULES FOR PARTICIPATION IN THE FESTIVAL

  1. To participate in the Festival, a valid Ticket must be presented to the Organizer before entering the Venue. The Ticket may be presented either as a printed (paper) document or in electronic form (displayed on an electronic device by the attendee). Upon presentation of a valid Ticket, the Organizer will verify eligibility for participation (especially age verification), exchange the Ticket for a Wristband and Festival tasting glass, and perform any other actions necessary to facilitate participation (e.g., providing organizational and safety information).
  2. Only sober adults are allowed to participate in the Festival. The Organizer reserves the right to deny entry to intoxicated persons or ask such persons to leave the Venue, especially if their behavior disturbs the peace, order, or the enjoyment of other attendees.
  3. A Ticket holder who cannot prove that they are at least 18 years old with a valid document (ID card or passport) will not receive a wristband or tasting glass and will be denied entry to the Festival. In such a case, CBMAX will not refund the ticket or be liable to the Buyer or the person attempting to enter.
  4. After exchanging a Ticket for a Wristband, the participant will also receive a tasting glass and a voucher pack for sampling whiskies available at selected exhibitor booths, under the same general rules for all participants. The Wristbands remain the property of CBMAX until issued to the participant based on the Ticket.
  5. The Buyer acknowledges that some exhibitors may require additional tasting vouchers or payment for certain whiskies, such as rare editions or vintage varieties.
  6. The Buyer is obligated to accept the Festival Participation Rules at the time of Ticket purchase and before entering the Venue and to inform all individuals for whom they purchased Tickets about the contents of these Rules.
  7. The Wristband and tasting glass are non-transferable, non-refundable, and cannot be shared with third parties.

6. REFUNDS

  1. Due to the nature of the product sold (a good with digital elements) and the consent the Buyer is required to give before finalizing the purchase, ticket refunds will not be accepted, except in the event of Festival cancellation, date change, or change of venue by the Organizer. Therefore, we kindly ask that purchases be made carefully, ensuring that the selected product meets all expectations before completing the transaction.

Customer support is available from Monday to Friday, between 9:00 a.m. and 5:00 p.m., excluding public holidays (Saturdays, Sundays, national and religious holidays).

  1. In the event of cancellation, change of date, or venue of the Festival, which entitles the Buyer to a refund, the Organizer will refund only the purchase price of the tickets. Any additional costs, such as transaction fees charged by payment operators, will not be reimbursed. Refunds will be processed within 31 days from the scheduled Festival date or the date for which the returned ticket was purchased. The refund will be issued using the original payment method.

7. COMPLAINTS REGARDING TICKETS

  1. CBMAX, as the seller, is liable to the Buyer who is a consumer (as defined in Article 221 of the Civil Code) for any non-compliance of the purchased Ticket with the sales contract, to the extent specified by the Polish Consumer Rights Act of May 30, 2014 (Journal of Laws 2024, item 1796, as amended).
  2. The basis and scope of the Organizer’s liability as the ticket seller for physical and legal defects (warranty) are defined in the Civil Code.
  3. The Organizer does not provide any warranty on the products purchased via the Service or items received under the Ticket (e.g., Wristband, tasting glass).
  4. Complaints should be submitted via e-mail to: kontakt@festiwalwhisky.pl. The e-mail should include as much detail as possible regarding the complaint, including the type and date of the issue, proof of payment for the ticket(s), and contact details of the complainant. Only the Buyer may submit a complaint. The more information provided, the faster and more efficiently CBMAX will be able to resolve the issue.
  5. CBMAX undertakes to review complaints within 14 days. If that is not possible, CBMAX will notify the Buyer within that time when the complaint will be addressed.
  6. All communication between the Organizer and the Buyer regarding complaints will be conducted via e-mail, using the Organizer’s address specified in section 7.4 and the Buyer’s e-mail address provided in the complaint submission.
  7. The Buyer has the right to choose the legal basis for the complaint and the type of claim they wish to pursue.
  8. Buyers who are consumers also have the right to use alternative dispute resolution methods, such as submitting a mediation request or a case to an arbitration court (application form available at www.uokik.gov.pl). A list of permanent arbitration courts operating at provincial trade inspection offices is also available on the website of the relevant WIIH. Consumers may also seek free assistance from a municipal or county consumer ombudsman or from a consumer protection organization.
  9. COMPLAINTS REGARDING ELECTRONIC SERVICE PROVISION
  1. CBMAX undertakes to ensure the proper functioning of the Service, to the extent permitted by current technical knowledge, and agrees to address any reported irregularities within a reasonable time.
  2. Service users should promptly report any irregularities or interruptions in the functioning of the Service to CBMAX via: e-mail: kontakt@festiwalwhisky.pl, or the contact form available on the Service.
  3. When submitting a complaint, users should provide: Full name, Mailing address, Type and date of the irregularity encountered, and Any additional information that may assist the Service administrator in resolving the issue.
  4. CBMAX undertakes to review each complaint within 14 days of its submission. If this is not possible, the user will be informed within that period of when the complaint will be resolved.
  5. Communication between the Organizer and the user regarding complaints about electronic services will be conducted via e-mail – using the Organizer’s address provided in section 8.2 and the e-mail address submitted by the complainant.
  6. PRIVACY AND PERSONAL DATA
  1. Due to the nature of the Festival and the necessity of verifying the age of Ticket holders, the Buyer must provide personal data when placing an order via the Service. The Buyer also agrees to identity and age verification at the moment of exchanging the Ticket for a Wristband upon entry to the Festival.
  2. Both the Buyer and participants who are not the Buyer are required to enable the Organizer to verify their age by presenting a valid document upon request – either an ID card or passport. Minors, individuals whose age cannot be confirmed, or who refuse to show an appropriate document will not be admitted to the Festival grounds.
  3. The Buyer may choose to consent to receiving commercial, promotional, and marketing information by electronic means, especially by e-mail, in accordance with the Act on Providing Services by Electronic Means and/or for profiling. In such cases, the Buyer’s personal data may be processed by CBMAX for advertising purposes, market research, or analysis of behavior and preferences – to improve the quality of CBMAX’s services – all based on the consent given.
  4. By accepting the relevant declarations in the Service, the Buyer consents to:
  1. The processing of personal data for purposes related to customer service, provision of electronic services, consideration or rejection of the Buyer’s offer, and conclusion and execution of the ticket sales agreement – this consent is necessary to form and fulfill the contract.
  2. Receiving Festival-related information from the Organizer – this consent is necessary.
  3. Receiving marketing and commercial content from CBMAX – this consent is voluntary and can be withdrawn at any time.
  4. In accordance with Articles 13 and 14 of the General Data Protection Regulation (GDPR) (EU) 2016/679, CBMAX informs that:
  1. The data controller is CBMAX (company details as stated in Section 1).
  2. For questions regarding the processing of personal data or to exercise data-related rights (e.g., withdrawal of consent), contact CBMAX via e-mail: kontakt@festiwalwhisky.pl.
  3. Personal data of Service users, Buyers, and any third parties whose data is provided to the Organizer are supplied either by the Buyer or by the user during ticket purchase or service use.
  4. Data is processed for:
  • Providing electronic services (contract performance, communication, claims handling, etc.) – based on legitimate interest (Art. 6(1)(f) GDPR),
  • Fulfilling legal obligations (e.g., consumer rights, tax law) – based on Art. 6(1)(c) GDPR.
  1. Buyer’s personal data is processed for:
  • Contract conclusion and execution, including delivery of Festival information and handling claims – based on Art. 6(1)(b) and (f),
  • Compliance with legal obligations – Art. 6(1)(c),
  • Marketing activities (with voluntary, withdrawable consent) – Art. 6(1)(a).
  1. The following types of data may be processed: name and surname, ID/passport number, phone number, e-mail, PESEL number (if required), residential or mailing address.
  2. Data recipients may include: service providers (e.g., IT, advisory, postal, logistics, financial, insurance), entities within the same capital group as CBMAX, and public authorities if legally required.
  3. Data provision is voluntary but necessary for ticket purchases or exercising rights such as complaints.
  4. Data will be processed until consent is withdrawn, unless longer retention is justified (e.g., legal claims or tax obligations).
  5. Data is retained according to the purpose for which it was collected and relevant limitation periods and legal obligations.
  6. Data will not be transferred outside the European Economic Area (EEA).
  7. Individuals whose data is processed have the right to access, rectify, delete, restrict processing, transfer data, and object (Art. 21(1) GDPR). Objections may be submitted by e-mail or postal mail (addresses provided in section 9.5.b).
  8. Data will not be subject to automated decision-making or profiling, unless separate, voluntary, and withdrawable consent is given.

10. FINAL PROVISIONS

  1. The content published on the Service is protected by copyright and is the property of CBMAX or third parties who have granted CBMAX a license for their use. Users of the Service are fully liable for any damage caused to CBMAX as a result of unauthorized use of such content. Unauthorized use (including copying, distributing, creating derivative works from individual elements of the Service, or reproducing its layout) constitutes
    a violation of CBMAX’s copyright and may result in civil and legal liability.
  2. Trademarks appearing on the Service are legally protected under intellectual property law and other applicable regulations, especially those governing trademark registration and protection.
  3. Any disputes arising between CBMAX and a Buyer who is a consumer under the applicable law, which cannot be resolved amicably, shall be submitted to the competent courts in accordance with the provisions of the Polish Code of Civil Procedure.
  4. By purchasing a Ticket, the user of the Service agrees to read and comply with both these Terms and Conditions and the Festival Participation Rules, and to provide copies of these documents to every person for whom a ticket has been purchased.
  5. These Terms and Conditions are governed by the laws of Poland.
